Chapter 33

What is said regarding the water with which human hair has been washed

باب الْمَاءِ الَّذِي يُغْسَلُ بِهِ شَعَرُ الإِنْسَانِ

‘Ata’ saw no harm in making threads and ropes out of human hair. The utilization of the thing which is licked or eaten by a dog, and the passing of dogs through the mosque. Az-Zuhri said, “It is permissible for one to perform ablution with water that has been licked by a dog, provided that there is no water except that.” Sufyan said, “This is the true religious verdict: Allah جل جلاله said: “And you find no water, then perform Tayammum.” (V.4:43).
وَكَانَ عَطَاءٌ لاَ يَرَى بِهِ بَأْسًا أَنْ يُتَّخَذَ مِنْهَا الْخُيُوطُ وَالْحِبَالُ، وَسُؤْرِ الْكِلاَبِ وَمَمَرِّهَا فِي الْمَسْجِدِ. وَقَالَ الزُّهْرِيُّ إِذَا وَلَغَ فِي إِنَاءٍ لَيْسَ لَهُ وَضُوءٌ غَيْرُهُ يَتَوَضَّأُ بِهِ. وَقَالَ سُفْيَانُ هَذَا الْفِقْهُ بِعَيْنِهِ، يَقُولُ اللَّهُ تَعَالَى: {فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا} وَهَذَا مَاءٌ، وَفِي النَّفْسِ مِنْهُ شَيْءٌ، يَتَوَضَّأُ بِهِ وَيَتَيَمَّمُ.

حَدَّثَنَا حَفْصُ بْنُ عُمَرَ، قَالَ حَدَّثَنَا شُعْبَةُ، عَنِ ابْنِ أَبِي السَّفَرِ، عَنِ الشَّعْبِيِّ، عَنْ عَدِيِّ بْنِ حَاتِمٍ، قَالَ سَأَلْتُ النَّبِيَّ صلى الله عليه وسلم فَقَالَ ‏"‏ إِذَا أَرْسَلْتَ كَلْبَكَ الْمُعَلَّمَ فَقَتَلَ فَكُلْ، وَإِذَا أَكَلَ فَلاَ تَأْكُلْ، فَإِنَّمَا أَمْسَكَهُ عَلَى نَفْسِهِ ‏"‏‏.‏ قُلْتُ أُرْسِلُ كَلْبِي فَأَجِدُ مَعَهُ كَلْبًا آخَرَ قَالَ ‏"‏ فَلاَ تَأْكُلْ، فَإِنَّمَا سَمَّيْتَ عَلَى كَلْبِكَ، وَلَمْ تُسَمِّ عَلَى كَلْبٍ آخَرَ ‏"‏‏.‏
`Adi bin Hatim:

I asked the Prophet (about the hunting dogs) and he replied, "If you let loose (with Allah's name) your tamed dog after a game and it hunts it, you may eat it, but if the dog eats of (that game) then do not eat it because the dog has hunted it for itself." I further said, "Sometimes I send my dog for hunting and find another dog with it. He said, "Do not eat the game for you have mentioned Allah's name only on sending your dog and not the other dog."
