Chapter 9

Seeking permission of a previously-married woman in words, and of a virgin by silence

باب اسْتِئْذَانِ الثَّيِّبِ فِي النِّكَاحِ بِالنُّطْقِ وَالْبِكْرِ بِالسُّكُوتِ ‏

حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ، وَقُتَيْبَةُ بْنُ سَعِيدٍ، قَالاَ حَدَّثَنَا مَالِكٌ، ح وَحَدَّثَنَا يَحْيَى، بْنُ يَحْيَى - وَاللَّفْظُ لَهُ - قَالَ قُلْتُ لِمَالِكٍ حَدَّثَكَ عَبْدُ اللَّهِ بْنُ الْفَضْلِ، عَنْ نَافِعِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ ‏ ‏.‏ قَالَ نَعَمْ ‏.‏
"‏ الأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا ‏"
Ibn 'Abbas (Allah be pleased with him) reported Allah's Apostle (ﷺ) as saying:

A woman without a husband has more right to her person than her guardian, and a virgin's consent must be asked from her, and her silence implies her consent.
